Climate Change: Conference & Resources

The UN Climate Change Conference is meeting in Cancun, Mexico from 29 November to 10 December 2010. The Towards Recognition blog has posted a listing of some of the migration/displacement-related side events due to take place. In addition, IRIN has compiled a guide on How to Sound Knowledgeable in Cancun: Selected Articles on the Humanitarian Implications of Climate Change.

Elsewhere, Jane McAdam has posted a preprint of her forthcoming International Journal of Refugee Law article in SSRN. It's entitled "Swimming Against the Tide: Why a Climate Change Displacement Treaty is Not the Answer." Here's the abstract:
Drawing on field work in Tuvalu, Kiribati and Bangladesh, this article argues that advocacy for a new treaty to address climate-related movement is presently misplaced for a number of reasons. The article does not deny the real impacts that climate change is already having on communities, or that migration is a normal adaptive response to such change. Rather, it queries the utility – and, importantly, the policy consequences – of pinning ‘solutions’ to climate change-related displacement on a multilateral instrument, in light of the likely nature of movement, the desires of communities affected by it, and the fact that a treaty will not, without wide ratification and implementation, ‘solve’ the humanitarian issue. The argument is developed by examining some conceptual and pragmatic difficulties in attempting to construct a refugee-like instrument for people fleeing the effects of climate change, and by critiquing whether there are legal benefits, as opposed to political benefits, to be gained by advocating for such an instrument.

Finally, Susan Martin's background paper for the World Migration Report on "Climate Change and International Migration" is now available on IOM's web site. The aim of the paper is to discuss "the potential impact of climate change on migration patterns, examine the existing capacities to address these forms of movement and the areas where capacity‐building is required, and make recommendations for addressing climate change-induced migration" (p. 6).

Focus: Substance Abuse

The ICMHD Blog recently published a post entitled "Four Loko and the broader issue of alcohol abuse: a particular concern for migrant groups." It notes:
Despite known links between alcohol abuse and issues of health, poverty, and violence, little concentrated action has been directed towards vulnerable migrant populations. This is not due to a lack of capability. An inexhaustible list of NGOs and agencies have long been working with migrant groups on related issues, yet remarkably few organizations include alcohol education or rehabilitation among their list of programs. This gap represents an unfortunate missed opportunity.
Also published recently, although not in full-text, was the following journal article: "Drinking and Displacement: A Systematic Review of the Influence of Forced Displacement on Harmful Alcohol Use" (Substance Use & Misuse, vol. 45, no. 13, Nov. 2010). The authors conclude that "There is a significant need to improve the quality and quantity of research on harmful alcohol use by forcibly displaced persons in order to better understand the scale and nature of the problem and inform appropriate response strategies" (p. 235). (Note: Other literature reviews that have focused on the issue of substance abuse among displaced populations are available via my forced migration research guide.)

The latest issue of Intervention: International Journal of Mental Health, Psychosocial Work and Counselling in Areas of Armed Conflict (vol. 8, no. 3, Nov. 2010) includes a focus on substance abuse in refugee settings, with the following articles: "Screening and brief intervention for high-risk alcohol use in Mae La refugee camp, Thailand: a pilot project on the feasibility of training and implementation," "Perspectives on alcohol and substance abuse in refugee settings: lessons from the field," and "The hunting of the snark: detecting and managing abusers of alcohol and other drugs in refugee camps – a commentary on Ezard et al. and Streel & Schilperoord."

A joint meeting between UNHCR and the Office of the UN High Commissioner for Human Rights (OHCHR) was held earlier in the year in Amman, Jordan.

African Refugees in Israel

The LGBT Asylum News blog recently circulated a news story published earlier in the year on a documentary film entitled Ha'plitim ("The Refugees") that "seeks to expose the moral and legal questions underlying refugee status in Israel." The article notes the following:
While Israel is party to the 1951 Convention relating to the Status of Refugees, the government has not yet adopted asylum legislation. An approximate 17,000 asylum-seekers have fled to Israel from Sudan, Eritrea, Democratic Republic of Congo, and the Ivory Coast. Many have been detained in prison camps and over 270 have been returned to Egypt.

Resources to Identify New States Parties

The Internal Displacement Monitoring Centre (IDMC) reports that Chad has become the third African country after Uganda and Sierra Leone to ratify the African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (Kampala Convention). Normally, you can monitor signatures and ratifications for African treaties by visiting the relevant page on the AU web site; however, it has not yet been updated to reflect the current status of the Kampala Convention.

Elsewhere, UNHCR's Global Appeal for 2011 includes an updated states parties list (as of 1 Oct. 2010) for the refugee and statelessness conventions. However, the actual signature/ratification dates are not indicated. The best resource to consult for this information is the UN Treaty Office database, which is regularly updated. See Chapter V: Refugees and Stateless Persons.

Commemorating Refugee Protection Milestones

UNHCR's just released Global Appeal for 2011 includes an indication of how the organization will be commemorating the upcoming anniversaries, of UNHCR's 60th on 14 December 2010, Fridtjof Nansen's 150th on 10 October 2011, and the refugee/statelessness conventions on 7-8 December 2011, respectively.

More recently, a meeting of Latin American nations in Brasilia just ended with the adoption of the Brasilia Declaration on the Protection of Refugees and Stateless Persons in the Americas. Held to mark the various aforementioned anniversaries, the gathering agreed "to do more for the protection of forcibly displaced and stateless people in the region" (see photo). Round-up of Resources: Language Analysis in the Asylum Process

The most recent issue of The Researcher, includes an interesting article entitled "Language Analysis for Determination of Origins, in light of the recent UK Upper Tribunal decision" (pp. 4-10). Here is the text of the case which the author analyzes. His intention is to examine the court's endorsement of the methods employed by the Swedish Language Analysis Company (Sprakab) and its "conclusion that language analysis reports and little else besides may be enough to establish nationality" (p. 4).

The article refers to (p. 5) the Guidelines for the Use of Language Analysis in relation to Questions of National Origin in Refugee Cases, which were published in June 2004 in response "to calls for qualified linguists to provide guidelines for use by governments and others in deciding whether and to what degree language analysis is reliable in particular cases." New Books on Human Trafficking

Cambridge University Press has published The International Law of Human Trafficking, by Anne T. Gallagher (available Sept. 2010 in the U.S. and Nov. 2010 elsewhere). The book is described as the "first-ever comprehensive survey and analysis of the international law of human trafficking, incorporating transnational criminal law, human rights, refugee law and international criminal law." The author discusses her book and other publications in this guest post on the IntLawGrrls blog.

The specific legal issue of "Trafficking and Asylum" is addressed in chapter 3, pp. 197-208. Sub-sections include "Trafficking and the Right to Seek and Receive Asylum," "Trafficking as the Basis for a Refugee Status," "Conclusion on Trafficking as a Basis for Asylum," and "A Note on Trafficking and Internal Displacement." Non-refoulement is discussed in chapter 6, "Obligations related to Repatriation and Remedies."

Ms. Gallagher is also a co-author of the just released ASEAN Handbook on International Legal Cooperation in Trafficking in Persons Cases (Asia Regional Trafficking in Persons Project, 2010), a new resource developed "to help improve cooperation between criminal justice officials who are involved in cross-border trafficking investigations."

(As an aside, there is another expert on human trafficking with a similar name: Anna Marie Gallagher, who serves as a resource person on this issue for the Southern Refugee Legal Aid Network (SRLAN)!)

Another publication out this month focuses on both Asia and Europe. Called Trafficking And Human Rights: European and Asia-Pacific Perspectives, it's edited by Leslie Holmes and published by Edward Elgar (Nov. 2010). Here's a bit from the blurb:
This fascinating study by international experts provides original research findings on human trafficking, with particular reference to Europe, South-East Asia and Australia. A major focus is on why and how many states and organisations act in ways that undermine trafficked victims’ rights, as part of ‘quadruple victimisation’. It compares and contrasts policies and suggests which seem to work best and why. The contributors also advocate radical new approaches that most states and other formal organisations appear loath to introduce, for reasons that are explored in this unique book.

IDP News: New Special Rapporteur, Kampala Convention Resource

Dr. Chaloka Beyani has been appointed as the new Special Rapporteur on the Human Rights of Internally Displaced Persons. He takes over from Mr. Walter Kälin, whose term ended October 2010. One of Dr. Beyani's recent accomplishments is his participation in the drafting of and negotiations involving the African Union Convention on Internally Displaced Persons (Kampala Convention).

Following on from its commemoration of the first anniversary of the Kampala Convention, the Internal Displacement Monitoring Centre (IDMC) has launched a new feature which introduces the convention, provides information about displacement in Africa, and promotes greater ratification and implementation of the convention. Use the menu on the left to navigate through the different sections.
