Guidelines for the Protection of People Fleeing Violence and Conflict

In his introductory statement to the 54th meeting of EXCOM's Standing Committee, the director of UNHCR's Division of International Protection referenced the evolving and complex nature of armed conflict and violence.  In the interest of determining how best to protect those who flee from such situations, he noted that

...UNHCR will develop guidelines on how international and regional refugee instruments apply to people fleeing violence and conflict across international borders. They will also identify in detail those who may not necessarily be covered by existing instruments and explore possible alternative frameworks or approaches in such instances. This research thus fits within broader discussions on protection gaps and temporary protection that we looked at as part of the commemorations cycle (p. 11).

New Innovation Unit at UNHCR

Thanks to the PDES Facebook page, I recently learned that UNHCR has a new Innovation Unit.  Of course, if I had just read this Standing Committee document, I would have found out about it sooner! It was also hinted at in this news story about the UNHCR/NGO Consultations.

Their remit, according to the unit's (not yet officially launched) web site, is as follows:

UNHCR Innovation is a vocal advocate and curator of creative thinking, positive experimentation, and unconventional partnerships. Our work uses a three-pronged approach. WE AMPLIFY: showcasing innovations already happening in the field, we highlight good practices and lessons learned. WE CONNECT: in order to solve field-identified challenges, we link likeminded innovators within UNHCR and connect them to time, resources, and support. WE EXPLORE: to complement the abundant knowledge within UNHCR, we find specialists in the private sector, academia, and other organizations to share their own expertise. By strengthening the network of like-minded innovators across the agency and externally, UNHCR Innovation strives to create lasting space and time for critical thinking within UNHCR’s organizational culture and its work around the world.

Refugee Claims Based on Climate Change

Jane McAdam very nicely replied to my question posed in yesterday's post.  She wrote to say that her book, Climate Change, Forced Migration, and International Law (Oxford Univ. Press, 2012), references other refugee cases that have involved climate change claims. In her chapter on "The Relevance of International Refugee Law," she notes that previous claimants have mainly come from Tuvalu, Kiribati, and Tonga and have attempted to seek protection in Australia and New Zealand (p. 47). She goes on to list the various decisions that have been issued by the NZ Refugee Status Appeals Authority (now the Immigration and Protection Tribunal) and the Australian Refugee Review Tribunal in a footnote on the same page.  None have been positive.

A list of climate change-related cases is also provided in an earlier paper by Jane, entitled "Climate Change Displacement and International Law: Complementary Protection Standards."

I decided to check Refworld to see what relevant case law it includes.  It currently only provides access to two decisions, one from the RRT involving a claimant from Kiribati and one from the RSAA involving claimants from Tuvalu - but perhaps the Refworld team can be persuaded to include the other ones highlighted in Jane's book!

This year, I have experimented with grouping references together on either a (roughly) thematic or regional basis.  (In the past, I essentially waited to accumulate five or so references and then I posted them under a "New Publications" heading.)

The advantage of proceeding in this fashion is that readers can more easily determine whether or not a post is relevant to them - and if it is, more of the references listed might be of interest.  The disadvantage is that it takes longer to compile such "mini-bibliographies," so when some references are finally posted, they are not quite as current as they could be.

My question to you is, do you have a preference?  Or an idea for a completely different approach?

2.  Do you have any other suggestions for the blog?  For example, "I would like more of x/less of y" or "Can you track x type of resource?"

3.  Finally, I've managed to stockpile a number of pending posts, which I'm now dutifully trying to get out there, so please forgive the deluge of information!
